The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over perceived violations of competition laws.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his 23XI team, revealing he invested $40 million of his personal wealth into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said during testimony. “As a newcomer, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport required examination through a new lens.”

The Core Dispute: Franchise System and Renewal Demands

The heart of the case involves the end of a 2016 deal where Nascar granted each team a franchise. The concept is similar to other professional sports with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.

Jordan was on the witness stand for an hour and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a picture of the global icon.

Spearheading the Fight

23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who preceded Jordan, are events from September 2024. She recounted a hectic and tense period where the sanctioning body informed teams they must sign a charter agreement extension. This agreement consists of 112 pages outlining pay for chartered teams and a guaranteed entry in every race.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. All other teams agreed to the terms.

Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or extension options. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Victory

But in the end, the pushback against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he purchased another franchise last year for $28m amid the legal dispute. “So I took the plunge.”

Account from the Gibbs Family

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She said the timing of the signature deadline didn’t sit well.

According to her, the team founder first attempted to call and persuade Nascar against forcing signatures, but Nascar’s leader refused the appeal.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
